Media Statement: Supreme Court to Hear Bill 21 in Landmark Test of Rights and Freedoms
As the Supreme Court of Canada begins hearings on the legal challenges to Act respecting the laicity of the State (Bill 21), the Canadian Muslim Forum believes this moment represents one of the most significant constitutional tests in recent Canadian history.
At stake is not only the future of a provincial law, but the broader question of how Canada protects fundamental freedoms, equality and the full participation of all citizens in public life. While presented as a measure to promote state neutrality, the practical impact of Bill 21 has been felt most strongly by women whose convictions are visibly expressed. For many, the law creates an unfair choice between their profession and their beliefs.
The case also raises important national questions about the increasing reliance on the Notwithstanding Clause within the Canadian Charter of Rights and Freedoms. What was intended as a rare constitutional mechanism must not become a routine instrument that weakens the protection of fundamental rights.
The Canadian Muslim Forum hopes that this historic hearing will reaffirm Canada’s commitment to equality, pluralism and the protection of civil liberties. In a diverse society, safeguarding the ability of women and all citizens to participate fully in public institutions is essential to preserving the democratic promise that defines Canada.
